Announcement No.82, 2006 of Ministry of Commerce,

General Administration of Customs and State Environmental Protection Administration, Promulgating Commodities Catalogue Prohibited form Processing Trade

 

In accordance with requirements of Circular of the Ministry of Finance, the National Development and Reform Commission, the Ministry of Commerce, the General Administration of Customs, the State Administration of Taxation of the People’s Republic of China, on Adjusting the Tax Refund Rate of Some Export Commodities and Supplementing the Commodities Catalogue Prohibited form Processing Trade (No.139, 2006), Ministry of Commerce, General Administration of Customs and State Environmental Protection Administration formulated catalogue of the new batch of commodities prohibited form processing trade (refer to appendix), which is now released. Related issues are now announced as follows:

 

1. This announcement will take effect as from Nov 22, 2006.

2. Operators of processing trade business approved by departments of commercial administration before Nov 22, 2006 are allowed applying for processing trade registration and shall be finished during valid period of the contract; network supervision enterprises base on enterprises unit are allowed finishing the processing trade business before Nov 22, 2007. in case of expiration, above business cannot be postponed and shall be dealt with in accordance with related regulations of processing trade.

3. In accordance Announcement No.52, 2006 of General Administration of Customs, Ministry of Finance, Ministry of Commerce, People’s Bank of China and the State Administration of Taxation, enterprises applying for domestic sales shall pay tax delaying interests in accordance with interest rate released by People’s Bank of China of last year of data of Customs Tax Paying Notice.

4. This announcement is applicable for special supervisory areas such as bonded areas and export processing zones, however enterprises established before release of this announcement are excluded.

5. Related regulations of Announcement No. 105, 2005 of Ministry of Commerce and General Administration of Customs on Prohibiting Pesticide and Coal Processing Trade are terminated while other regulations shall continue to be effective.

 

Catalogue of the new batch of commodities prohibited form processing trade shall be subject to this announcement, which will be adjusted dynamically in accordance with related policies of the state.
